Below you will find the - Guidance for the FY 2010 Welfare Assistance Distribution Methodology that was signed by Assistant Secretary - Indian Affairs Larry Echo Hawk on February 26, 2010. The end-of-year Financial Assistance and Social Service Report (FASSR) must be electronically completed by March 29, 2010 and sent to Ken Reinfeld of OSGA FASSR spreadsheet in Excel  format (one for tribes operating under a fiscal year and one for tribes operating under a calendar year).

(1) Memorandum to Tribal Self-Governance Coordinators from OSG Director Freeman notifying them that the FY 2010 Welfare Distribution Methodology and Forms have been posted on the Self-Governance Communication & Education website; (PDF)

In this Notice, the Office of Self-Governance establishes a March 1, 2010 deadline for tribes/consortia to submit completed applications to begin participation in the tribal self-governance program in fiscal year 2011 or calendar year 2011.  A copy of the regulations guiding the application and selection process (25 CFR Parts 1000.10 to 1000.30) is also provided. Dear Tribal Leaders with "477 Programs":

This letter is an important update to our letter of October 17, 2008, (copy enclosed) informing you that the Department of Health and Human Services (DHHS) was discontinuing use of Pub. L. 93-638 as the authority to issue Pub. L. 102-477 contracts, effective January 1, 2009. DHHS has extended the date to March 31, 2009. Accordingly, this office will continue to transfer DHHS program funds through contracts based on Pub. L. 93-638……

The U.S. District Court upheld the Tribe’s position which involved the question of whether IHS could reject a tribal compact based on the fact that the Tribe charged beneficiaries for pharmacy services. The court ruled in the Tribe's favor, saying that the IHS could not reject the proposed compact and FA on these grounds. A copy of the decision is below.”
